The AGD rate as a benchmark

The Vergütungstarifvertrag Design (design fee agreement) of the Allianz deutscher Designer (AGD) sets a minimum hourly rate of €105, and €120 for strategic design.

The rate is not mandatory, but it gives an indication of what professional design work costs. If you pay for only a few hours for a logo with two drafts and two revision rounds, ask how much time actually goes into the work. FNLY Social charges €95 an hour for design, €105 for development and €120 for concept work.

Usage rights to the logo

Have the rights to your logo granted in writing, exclusively and without time limit, including the right to modify it and register it as a trademark.

Without an agreement, the scope is determined by the purpose of the contract (§ 31 (5) UrhG), and in a dispute a court decides. In a case before the OLG Frankfurt (Higher Regional Court of Frankfurt, judgment of 12 June 2019, case no. 11 U 51/18), an agency demanded money for the continued use of a logo after the collaboration had ended. The court found the logo was not protected by copyright and granted the company an unlimited right of use. A written contract would have avoided the dispute.
